Tippy Tap Training LLC (TTT), its owners, representatives, employees, or affiliates and the employees, officers, directors, and agents of each and all of them, shall henceforth be referred to as “TTT”.  The registering dog or puppy shall henceforth be referred to as "Canine". The registering Canine’s owner and/or authorized agent(s) shall be referred to as “Owner”.  Any and all activities hosted, offered, or put forth, by TTT including but not limited to; classes, events, functions, seminars, walks, trials, private training etc. shall henceforth be referred to as the “Activity”.

TTT reserves the right to deny any Canine with any aggression issues to any and all Activities at any time.  The Owner understands and agrees that the Canine does not have a history of aggression, any aggressive tendencies, and that all now known and hereafter known aggression or aggressive tendencies have and will be thoroughly disclosed to TTT before attendance to any Activity.  The Owner understands and agrees that aggressive behaviors warranting removal from the Activity shall be determined at the sole discretion of TTT. The Owner understands and agrees that if the Canine exhibits any aggression pertaining to other dog(s) or person(s), it will be removed from training and no refund will be offered.

TTT reserves the right to deny any Canine with anxiety to any and all Activities at any time.  The Owner understands and agrees that the Canine does not have a history of anxious tendencies that may lead to harm for themselves, other animals, person(s), or property and that all now known and hereafter known anxious tendencies have and will be thoroughly disclosed to TTT before attendance to any Activity. The Owner understands and agrees that anxiety behaviors warranting removal from the Activity shall be determined at the sole discretion of TTT.  The Owner understands and agrees that if the Canine exhibits any anxiety pertaining to other dog(s) or person(s), it may be removed from training and no refund will be offered.

TTT reserves the right to deny any Canine that is not current on the following inoculations: Rabies, DHLPP, and Bordetella (K9 Kennel Cough).  The Owner understands and agrees that the Canine is up to date on those shots prior to attendance to any Activity and to present a record of those vaccines via hard copy or digital.  ​

 

General Liability:​

The Owner understands that participating in any Activity may involve risks to themselves, members of their family, guests, agents, other person(s) or the Canine. The Owner hereby agrees to accept and assume all risks of illness, personal or psychological injury, pain, suffering, temporary or permanent disability, death, property damage, and/or financial loss arising therefrom, whether caused by the ordinary negligence of TTT or otherwise.  The Owner will not hold Jennifer Schretter or TTT responsible in the event of illness, injury, pain, suffering, temporary or permanent disability, or property damage to the Owner, their family members, guests, agents, other person(s) or the Canine.  The Owner hereby expressly waives and releases any and all claims, now known or hereafter known, against TTT on account of personal or psychological injury, illness, pain, suffering, temporary or permanent disability, death, property damage, or financial loss arising out of or attributable to the Owner participating in the Activity, whether arising out of the ordinary negligence of TTT or any Releasees or otherwise.

The Owner expressly understands, acknowledges, and agrees that they are at all times responsible for the actions of the Canine regardless of who is controlling the Canine.  Further that all behavioral advice and training suggestions are provided at the Owner's own risk. Use of information is voluntary and TTT is not responsible for injury to the Canine, the Owner, or to another person(s), animal(s), or property damage.

 

The Owner agrees to comply with the verbal and/or written instructions given to them from the training instructor(s) as it relates to the Owner or the Canine’s ability to safely participate in the Activity. The Owner also agrees to assume any and all responsibility to any damages done to property, person(s), or other dogs done by the Owner or the Canine’s actions.

 

The Owner acknowledges that when participating in the Activity, they grant Jennifer Schretter and TTT to use any training equipment deemed appropriate to work with the Canine. Examples include but are not limited to: martingale collars, no-pull harnesses, long lines, etc. The Owner acknowledges that these are tools that will only be used in a humane way by competent and qualified person(s).

 

As lawful consideration for participating in any Activity with TTT, the Owner, for themselves, their heirs, next of kin, executors, administrators, legal representatives, successors and assigns, hereby waive, release, discharge and covenant not to sue and to indemnify, defend, and hold harmless Jennifer Schretter and TTT from any and all injuries, losses, claims, and damages to any person or persons of any nature its directors, officers, employees, agents, sponsors, organizers, volunteers, or other representatives, their successors and/or assigns, from any and all liability to the Owner for any loss, harm, damage, claim, injury, or accident to the person or property of the Owner, whether caused by any ordinary negligent act or omission of TTT while the Owner or the Canine is engaged in or participating in any Activity or using any trainer or business facilities in connection therewith.

Care and Maintenance of Dogs:​

If the Canine is found to have fleas, ticks, or internal parasites it will be removed from all Activities until the Canine has been treated and free of infestation (at Owner's expense). For any Canine boarding at Tippy Tap Training LLC; TTT recommends the Owner applies monthly flea and tick topical in addition to *mandatory* monthly heart worm preventative. Intestinal parasites are sometimes un-avoidable despite the cleanliness of an environment.  If the Canine is found to have developed any infectious disease or parasite the Owner will notify TTT immediately and the Canine will be removed from all Activities without refund until cleared by a veterinarian.

Media Permission:​

The Owner gives TTT their permission for such use and publicity for such purposes, according to the terms and conditions set forth in this Contract.  The Owner hereby irrevocably permits, authorizes, grants, and licenses TTT the rights to display, transmit, broadcast, reproduce, record, photograph, digitize, modify, alter, edit, and otherwise use the Owner’s or Canine’s likeness or voice, and all materials created by or on behalf of TTT that incorporate any of the foregoing ("Materials") in any medium or format, including but not limited to, on the internet and other digital transmission or delivery methods on any platform without further consent from or royalty, payment, or other compensation to the Owner. TTT shall be the exclusive owner of all rights, including copyright, in the Materials.

TTT will make reasonable efforts to obscure the Owners identity but makes no vows or guarantees as to such.  The Owner acknowledges and agrees that they have no right to review or approve Materials before they are used by TTT. Any credit or other acknowledgment of the Owner, if any, shall be determined by TTT in its sole discretion. TTT has no obligation to create or use the Materials or to exercise any rights given by this Contract. To the fullest extent permitted by applicable law, the Owner hereby irrevocably waives all legal and equitable rights relating to all liabilities, claims, demands, actions, suits, damages, and expenses, including but not limited to claims for copyright or trademark infringement, infringement of moral rights, libel, defamation, invasion of any rights of privacy (including but not limited to intrusion, false light, public disclosure of private facts, and misappropriation of name or likeness), violation of rights of publicity, physical or emotional injury or distress, or any similar claim or cause of action in tort, contract, or any other legal theory, now known or hereafter known in any jurisdiction throughout the world (collectively, "Claims"), arising directly or indirectly from TTT's exercise of their rights under this Contract or the production, exhibition, exploitation, advertising, promotion, or other use of the Materials, and whether resulting in whole or in part from the negligence of TTT or any other person.  The Owner hereby covenant not to make or bring any such Claim against TTT and forever release and discharge TTT from liability under such Claims.​

Payment:​

Prices are subject to change without notice.  All Activities require a 50% deposit to hold a spot in the Activity and/or on the schedule.  The Owner understands and agrees that all deposits are nonrefundable.  

 

For classes, walks, events, and seminars payment in full is due 3 days before the start of the Activity.  For Training Day Camp and dog sitting payment in full is due at or before pick up of the Canine.  Any cancellations 3 days prior to the Activity start day will receive a refund minus the deposit.  Cancellations less than 3 days prior to the start date of the Activity are not eligible for a refund.  Payments are non transferable less than 3 days prior to the start of the Activity.

The Owner understands and agrees that any payment not made in full 3 days prior to the Activity start may result in the removal of the Canine.  The Owner understands and agrees that any payments not made in full within 14 days of the start of the Activity will result in the removal of the Canine from the Activity and the Owner, the Canine and any future Canines, owned by the Owner will be barred from participation in any TTT Activities until payment in full is received.  The Owner, the Canine and any future Canines owned by the Owner may be barred from any and all future Activities at the discretion of TTT if payment in full is not made within 30 days of the start of the Activity.  If payment in full is not received within 30 days of the Activity the Owner understands that TTT may seek legal recourse in pursuit of payment.

Training Guarantee:​

The Owner understands and agrees that any person(s) participating with the Canine in any Activity must also work on the assigned homework presented during lessons in order to train the dog. The Owner understands and agrees that training will only be effective when maintained and practiced with consistency on a regular basis. ​

​

The Owner understands and agrees that once the Canine enrolled in an Activity leaves the Activity, it is up to the Owner to practice and maintain training and boundaries in order to sustain the Canine's training. The Owner understands that any training done solely by the trainer (Training Day Camp, Dog Walking etc.) will result in the Canine responding to the TTT trainer and that the Canine may not initially respond as reliably to the Owner.  To understand and apply the basic principles of training the Owner may participate in a transfer session with the trainer.  The Owner agrees to use commands supplied by the trainer and to integrate training into daily life to support behavioral goals.

 

The Owner understands and agrees that the length of training required and what can be accomplished depends on multiple factors including but not limited to; the Canine’s prior experience and capacity to learn and the Owner’s ability to maintain a consistent and positive program.  Because of this, training may take longer than expected in some cases. In rare cases, training to the Owners goals may not be possible at all.  The Owner understands and agrees that if the Canine has not met some of the training goals after the agreed upon Activities, additional Activities may be added at an additional cost.

For these reasons, we do not guarantee any training and all payments are non refundable.

Covid Release:​

The Owner is aware and understands that participation in the Activity may involve the risk of illness, serious injury, disability, death, and/or property damage. The Owner is also aware of the contagious nature of bacterial and viral diseases, including but not limited to COVID-19 and the risk that they may be exposed to or contract the COVID-19 or other bacterial or viral diseases by engaging in any TTT Activity, which may result in illness, injury, pain, suffering, temporary or permanent disability, or property damage. The Owner understands that TTT cannot guarantee that the Owner will not be injured or become infected with any infectious diseases during the Owners participation in the Activity and that engaging in the Activity may increase the Owners risk of contracting a disease or illness. Notwithstanding these risks, the Owner acknowledges that they are voluntarily participating in the Activity with knowledge of the dangers involved.  

 

The Owner agrees to comply with all federal, state, and local laws, orders, directives, and guidelines related to any bacterial or viral diseases, including but not limited to COVID-19, while participating in the Activity, including, without limitation, requirements related to hand sanitation, social distancing, and use of face coverings. The Owner will also follow all instructions, recommendations, and cautions of TTT at all times during the Activity.

Training Day Camp Release:​

The Owner has the right to visit the trainer's home prior to enrollment in Training Day Camp.  The Owner understands and agrees that the enrollment of the Canine in Training Day camp grants approval of the trainer's home regardless of acceptance or denial of right to visit the trainer's home. The Canine will be kept indoors except for training purposes, elimination needs, or exercise time for the duration of the training.  The Owner certifies that they approve of the home and its containment of the Canine regardless of acceptance or denial of the right to visit the trainer's home. If the Canine causes damage to the trainer's home or TTT, the Owner understands that they are responsible for said property or person(s).

The Owner understands that the Canine will be fed per the Owners instructions and food must be provided by the Owner.  The Owner understands and agrees that TTT may adjust feedings slightly based on activity levels or training treat intake to maintain the health and wellbeing of the Canine.  TTT recommends feeding dogs twice daily to avoid bloat and gastric upset and to ensure proper energy needs.  While the Owner certifies that the Canine is vaccinated, they understand and accept that circumstances occur and pets get sick and even have viral breakthroughs despite vaccines.  The Owner understands and agrees that TTT is not liable for any sickness or disease with any resulting treatment being the sole financial burden of the Owner. 
 

All Canines enrolled in the Training Day Camp program are kept in a safe, home environment with access to a private crate if desired. The Canine may be crated on occasion for various reasons in the climate controlled in-door “dog area.” Each boarding space has constant fresh water available. The outdoor space is fully fenced and the Canine is provided with dog safe chew toys to keep them occupied when they are not training or exercising.  TTT does its best to maintain a sanitary and dry environment. A competent and qualified person will be on-site 24 hours a day with the Canine. If circumstances require that the Canine be left crated without person(s) on site for a period of time the Owner will be notified with the option to pick up the Canine for the day.

The Owner acknowledges and agrees that the Canine may be transported to training areas off site from the TTT location.  The Owner acknowledges that the Canine may have exposure to swimming water, other dogs, and various terrains that could be dangerous for the Canine. TTT does not want a dog injured during their stay. TTT vows to do their very best to keep all Canines safe in every way. Due to the nature of training environments, and general dog activity/behavior, possible accidental situations must be taken into consideration. The Owner understands and agrees to not seek any legal or financial action against Jennifer Schretter, Nicholas Schretter, or TTT in the case of death or injury of the Canine from any and all accidents including but not limited to: Insect bites, heat-stroke, death or injury from automobile, severe allergic reactions, or gastric dilatation/volvulus (bloat).  The Owner understands and agrees that any and all veterinary expenses incurred with relation to enrollment in Training Day Camp, dog walking, and other Activities are the sole financial burden of the Owner.

Training Day Camp Emergency Veterinary Care:

The Owner grants permission to Jennifer Schretter and TTT to transport the Canine for veterinary care if it is necessary to do so. It is understood that emergency care may not necessarily be issued by the Owner's regular veterinarian.  The Owner grants permission to Jennifer Schretter and TTT to make decisions about the immediate health care of the Canine in an emergency situation. The Owner understands and agrees that all veterinarian expenses will be reimbursed by the Owner in the event that immediate costs must be paid at time of treatment.

Electronic Signature:

The Owner represents and warrants to TTT that they are at least 18 years of age, and they have full right, power, and authority to enter into this Contract and grant the rights granted herein.  The Owner understands and agrees that by selecting the “I agree” box they are acknowledging and signing this Contract.  That the “I agree” check box is the legal equivalent of the Owners manual/handwritten signature and they consent to be legally bound to this Contract. The Owner further agrees their signature on this document is as valid as if they signed the document in writing. Under penalty of perjury, the Owner herewith affirms that their acceptance, were given by themself with full knowledge and consent and they are legally bound to these terms and conditions. This Contract constitutes the sole and entire agreement of the parties with respect to the subject matter contained herein and supersedes all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, with respect to such subject matter. This Contract shall be governed by the laws of the state TTT maintains its primary location.  If any term or provision of this Contract is invalid, illegal, or unenforceable in any jurisdiction, such invalidity, illegality, or unenforceability shall not affect any other term or provision of this Contract or invalidate or render unenforceable such term or provision in any other jurisdiction.

Furthermore the Owner acknowledges and agrees that this Contract is valid, legal, and binding with or without the Owner's signature.  This Contract is effective and the Owner agrees to its terms upon either the electronic signature of this Contract or the participation in any Activity with relation to TTT, whichever comes first.  That the participation in any TTT Activity is to consent to be legally bound to this Contract and is as valid as if they signed the document in writing.
